The information on each athlete profile has been provided by the account holder and is not verified or represented as accurate by Athlete InSite in any way. Athletes understand that they are 100% accountable for any representations they make,

helps users assemble their information used to communicate with coaches, recruites and administrators, however Athlete InSite makes no representations about the ability of that information in securing the user a scholarship, position or any
other relationship with a school, college or university. Athlete InSite takes user privacy very seriously and we will not share any information with any coaches, recruiters, administrators, partners or third party organizations without the consent
of the athlete, or the athlete’s parent/guardian if the athlete is under 18 years old.

Websites built on the Athlete InSite platform must comply with certain rules or they are subject to editing and or removal by Athlete InSite. It is important to us that the sites generated using our tools include safe content, and respect user privacy and trust. Our policies, processes, and technologies are designed to protect the interests of our customers. Our Publishing Guidelines provide all of the following: 

• Personal privacy—Customer privacy is upheld with strict guidelines and policies. We do not collect, track, or share personally identifiable information, and we never share individual data with third parties unless the user grants us the permission to do so. Any information that is collected may be shared solely at the discretion of the user.

• Clear ad indicators—Each advertisement is marked with an “Ad” indicator making it easy to identify. 

In addition, to ensure we deliver the highest quality experience, all websites and communications must follow the guidelines as outlined in this document. We exclusively reserve the right to reject any website that doesn’t meet the minimum guidelines or any website that we feel isn’t appropriate for our users. Our apps, website and platform cater to the youth and young adult market and as such must follow the most stringent guidelines for user safety.

Overview

Guidelines in this document apply to any and all types of information (text, photos, videos, etc.) appearing on our user websites. 

Guidelines in this document are not intended as legal advice. Adherence to the guidelines is not necessarily sufficient to meet the standards of state, provincial, or federal laws. We encourage each user to consult with legal counsel about the content, claims and assets used in their website.

Any assets such as photos or videos must be 100% owned or licensed by the user. If any asset is found to be infringing on a copyright or trademark, Athlete InSite may remove the materials and the user is subject to account cancellation. Athlete InSite is in no way responsible for users that post any information that do not own or have not licensed.

We reserve the sole and exclusive right to reject any website that does not meet the minimum guidelines, or any website that we feel is not appropriate for our platform or its users.

General Content

Animation                                            Repetitive, rapid flashing, or excessive or visually stressful

Marketing Guidelines                          Using our name, products, logo, or other brand attributes 
                                                            without prior approval is not permitted. Content on websites 
                                                            may not represent or imply any endorsement or validation from 
                                                            Athlete InSite.

Audio                                                   Audio as contained in video clips must be appropriate for all 
                                                            audiences. For example, suggestive or sexually oriented audio, 
                                                            or audio that contains profanity, vulgarity, or violence etc. is not 
                                                            allowed.

Defamatory Content                            Anything that facilitates or promotes defamatory, libelous, 
                                                            slanderous, or unlawful content is not allowed. 

Profane Content                                  Any content that facilitates, promotes, or uses profanity 
                                                            (including distasteful wording or phrases) is not allowed. 

Restricted Content 

We are committed to providing the highest quality experience. To meet this standard, the following areas require additional considerations, reviews, and approvals before being accepted on our platform.

Age-Restricted Content                       Websites must not contain links or promote age-sensitive 
                                                             products and services and must be appropriately age targeted. 

Alcohol                                                Websites must not contain content or links for alcoholic 
                                                            beverages. There can be no images or videos that show the 
                                                            consumption of alcohol products. All text, images, video, and 
                                                            audio must depict age-appropriate people and scenes. 

Controversial Public Issues                Wesbites may not present, include or reference a position on a 
                                                            controversial public issue. This may include content that is 
                                                            deemed offensive contains graphic or potentially offensive 
                                                            content, or is deemed an attack of a personal nature, an attack 
                                                            on an individual business, or a comment on a private dispute. 

Image Rights and Logo Usage           A website’s use of a third-party logos, images and videos are  
                                                            included at the user’s risk. It is assumed that the inclusion of 
                                                            any intellectual property, logo, graphic, artwork, audio, video, 
                                                            film, celebrity, or person is properly licensed for use by the user. 

Pharmaceutical                                   Website content or links promoting pharmaceutical products, 
                                                            medical devices, medical services, or treatments must comply 
                                                            with all applicable federal, state, local, provincial and, if 
                                                            applicable, foreign country laws or regulations. Additional 
                                                            restrictions on the promotion of such products for cross-border 
                                                `           sales may apply. 

Unacceptable or Prohibited Content

We are committed to providing the highest quality advertising experience. Therefore, we will not accept ads containing forbidden content listed in this section.

                                                            imagery that explicitly or implicitly references any adult subject. 
                                                            • Content that promotes adult-oriented themes or graphic

                                                            that promotes “how to” and other sex games. 

Discriminatory Content                        • Text or imagery that facilitates or promotes hate toward an 
                                                            individual or group of any race, sex, creed, national origin, 
                                                            disability, religious affiliation, age, language, or sexual 
                                                            orientation. 
                                                            • Content that advocates, promotes or contains discrimination 
                                                            based on age, gender, religion, ethnicity, race, disability, or 
                                                            sexual preference. 

Clickbait                                               • Content using sensationalized headlines and text descriptions 
                                                            to tempt a person into clicking. 
                                                            • Controlled or Intoxicating Substances Ad content 
                                                            or imagery that directly or indirectly, expressly or implicitly 
                                                            promotes or facilitates the sale, distribution, consumption, 
                                                            adoption, support, or use of any tobacco products or  
                                                            recreational drugs (substances that intoxicate or alter the 
                                                            mental state, whether lawful or not in any jurisdiction), tobacco 
                                                            or drug paraphernalia or apparatuses used in tobacco or 
                                                            recreational drug use, excessive alcohol consumption, or 
                                                            alcohol use by minors or individuals below the legal drinking age 
                                                            in the jurisdiction where the content or imagery is displayed. 

Deceptive Messaging                         • False, fraudulent, or deceptive claims or messaging including 
                                                            misleading titles, statements, or illustrations, and including. 
                                                            • Usenet, newsgroup or peer-to-peer file-sharing networks that 
                                                            allow users to download or access files directly from other 
                                                            users.

Gambling                                             Content that promotes or facilitates real money gambling. 

Weapons                                             Ad content that directly or indirectly facilitates or promotes the 
                                                            sale or use of weapons, ammunition, or explosive items or 
                                                            materials (such as bombs, grenades, fireworks, or firecrackers), 
                                                            as well as instructional materials relating to creating, 
                                                            assembling, enhancing, or acquiring explosive items.

Rights and Responsibilities

It is the user’s responsibility to ensure all the following requirements. 

• Website content complies with all applicable federal, state/provincial and local laws or regulations.

• Website content does not violate the intellectual property or other legal rights of third parties. 

• All claims made in a website must have been substantiated before the website goes live. 

• Website content is COPPA and CARU compliant.

• All content appearing within the website has the appropriate rights and licenses, whether imagery, logos or text.

Athlete InSite Personalized Websites for Student Athletes

RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

IN CONSIDERATION of my being permitted to use the tools and online services (the “services”) of Athlete InSite, I, for myself, my personal representatives, assigns, heirs, and next of kin (referred to as “I” or “me”) agree to all the terms and conditions set forth in this agreement (the “Agreement”). I desire to use the Services provided by Athlete InSite.

I ACKNOWLEDGE THAT I AM AT LEAST 18 YEARS OF AGE, OR AM THE CONSENTING PARENT OF AN ATHLETE UNDER THE AGE OF 18. I ACKNOWLEDGE THAT THE SERVICES ARE DESIGNED TO ASSIST THE USER IN COMMUNICATING WITH COACHES, RECRUITERS AND ADMINSTRATORS, WITH THE INTENT OF ESTABLISHING A RELATIONSHIP IN WHICH THE USER COMES TO AN AGREEMENT WITH AN EDUCATIONAL INSTITUTION REGARDING PLAYING SPORTS AT THE INSTITUTION, RECEIVING A SCHOLARSHIP OR BOTH. ATHLETE INSITE IS JUST A FACILITATOR OF THE SHARING OF INFORMATION BETWEEN THE USER AN EDUCATIONAL INSTITUTIONS AND IS NO WAY RESPONSIBLE FOR ANY COMMUNICATIONS THAT MAY NEGATIVELY IMPACT THE USER’S ABILITY TO ACHIEVE THEIR GOALS. ATHLETE INSITE DOES NOT REPRESENT THAT THE WEBSITE CREATED WILL GUARANTEE AN SPECIFIC OUTCOME. 100% OF THE CONTENT CONTAINED ON THE USER’S WEBSITE IS THE RESPONSIBILITY AND REPRESENTATION OF THE USER. ATHLETE INSITE DOES NOT CONFIRM, VET OR VALIDATE ANY USER INFORMATION AND ATHLETE INSITE IS IN NO WAY RESPONSIBLE FOR INACCURATE OR MISLEADING INFORMATION CONTAINED ON A USER WEBSITE. USER IS RESPONSIBLE FOR USING MATERIALS THAT THEY EITHER OWN OR LICENSE THE RIGHTS TO – ATHLETE INSITE IS IN NO WAY RESPONSIBLE FOR THE INAPPROPRIATE USE OF UNAUTHORIZED IMAGES OR CONTENT. UNAUTHORIZED IMAGES AND CONTENT ARE SUBJECT TO REMOVAL AND POTENTIAL ACCOUNT CANCELLATION. ANY PERSON OR COMPANY THAT CLAIMS THEIR CONTENT OR IMAGES HAVE INAPPROPRIATELY USED BY AN ATHLETE INSITE USER SHOULD CONTACT ATHLETE INSITE IMMEDIATELY REQUESTING REMOVAL OF SUCH CONTENT. ATHLETE INSITE WILL NOT SHARE ANY PERSONAL INFORMATION ABOUT THE USER WITHOUT THE USER’S EXPRESSED CONSENT.

By using the Services, I hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against the Provider, their affiliates, organizations or associations that promote or require use of the Services, their sponsors, and their subject master experts and their officers, directors, managers employees, agents, representatives, affiliates, shareholders, members, successors, and assigns (collectively, “Releasees”), on account inappropriate or misleading information, whether arising out of the negligence of the Provider or any Releasees or otherwise. I covenant not to make or bring any such claim against the Provider or any other Releasee, and forever release and discharge the Provider and all other Releasees from liability under such claims. I hereby represent that I have full power and all requisite authority to execute this Agreement and the release of liability contained herein, and that I have not in any way assigned or otherwise transferred the claims released under the terms of this Agreement.

This Agreement and the terms found in the apps and online at www.athleteinsite.com constitute the sole and entire agreement of the Provider and me with respect to the Services and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such Services. To an extent of a conflict between the Terms of Use and this Agreement, this Agreement shall control. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of the Provider and me and their respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule. Any and all disputes arising under this Agreement shall be sealed by binding arbitration as provided in the Terms of Use.

Introduction

Website and related services provided by Athlete InSite (collectively, “the Service”) are operated by Athlete InSite (“us”, “we”, “the Company” or “the Companies”). By accessing or using our web site at www.athleteinsite.com or the mobile version thereof (the “Site”), you (the “User”) signify that you have read, understand and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”), whether or not you are a registered member of Service. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Service or the Site after any such changes constitutes your acceptance of the new Terms of Use. Registration Data; Account Security

Proprietary Rights in Site Content; Limited License

All content on the Site and in the user websites (including all data provided by you) and available through the Service (the “Site Content”) is the proprietary property of the Companies with all rights reserved. Payment Terms

Users of our services require the payment of a fee. Available plans and costs are provided on the website at www.athleteinsite.com.

Cancellation Policy

You may cancel your membership/registration at any time using the link that can be found on your dashboard when you sign into your account. If you choose to cancel your account please be advised that any data that had been entered by the user or any other source, compiled and saved will no longer be available if the user chooses to delete their account. This action is permanent and not recoverable.

If a user is not in compliance with these terms and conditions, we reserve the right to contact them to remedy the issue and/or cancel their access to our services.

Trademarks

“Athlete InSite” and other related graphics, logos, designs, page headers, button icons, scripts and service names are trademarks, trademarks or trade dress of the Companies in the U.S. and/or other countries. The Companies’ trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of the Companies.

User Conduct

You agree not to use the Service or the Site to:

Harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;

Use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site; upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;

Upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law; use or attempt to use another’s account, service or system without authorization from the Companies, or create a false identity on the Service or the Site; or

Upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of Companies, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Companies or its users to any harm or liability of any type.

Mobile Services

The Service includes certain services that are available via your mobile phone, including (i) the ability to view the site, edit the content and share the site via your mobile phone and (ii) the ability to access certain Service features through a mobile application you have downloaded and installed on your mobile phone (collectively the “Mobile Services”). In the event you change or deactivate your mobile telephone number, you agree to promptly update your Service account information to ensure that your messages are not sent to the person that acquires your old number.

The Products, Site and the Service may be temporarily unavailable from time to time for maintenance or other reasons. Companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. The Companies are not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to User’s or to any other person’s computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Web and/or in connection with the Service. The service includes a simple process in which you simply answer some questions and upload a few documents and our design engine creates a professional website, that you can share with anyone with just a click. No code to write. Nothing to design. It is all done for you. And as you enter your information you can watch as the site is created automatically right before your eyes.

Do you offer websites for every sport?

Athlete Insite offers websites for every college sport and other sports as well. Are you a recruiting service?

Although we help to make your recruiting process easier, we are not a recruiting service.

Can you help me get a scholarship?

Athlete Insite is a tool used to help get you visibility. The website you create using our process will help you put your best foot forward and stand out from the competition, increasing the odds of success. But we do not offer scholarships or help you get scholarships.

How old do I need to be to have my own website?

Athletes of all ages are welcome to sign up for their own website. However, those under 18 years old require their parent/guardian’s permission to sign up.

How old do I need to be to start contacting coaches/schools?

Keep in mind that each school has a threshold of abilities they are looking for – some higher than others – to be considered for their team. Until an athlete is fully developed, they will likely not be at a level that will gain their interest. So having a site to capture and manage your information is a great idea at any age, but if you are too early in the process you may not get the attention of coaches. In fact, if you start reaching out to coaches too early it might be a nuisance to them. Just use your best judgement and if you have a question about when to start contacting coaches check with your current coach.

I play two sports – can I show both on one website?

If you play multiple sports, we unfortunately do not allow them all on one web page. If you want to have a site for each of your sports, you will need to sign up and create each site individually.

I don’t play for my high school – but I play competitively (travel, club, etc.) – can I still build a website?

Anybody can create their own website, regardless of who they play for or what team they’re on. Colleges and Universities are looking for talent, regardless of where you play.

Are there any division or conference rules or regulations against having a website?

For high school athletes there are not any rules or regulations against having a website. However, it is important to know that communications (as well as school visits, coach visits, etc.) can only take place during certain times of the year. And to make matters more complex, the dates vary for each sport, as well as by division or conference. You will want to be careful that you are following the correct guidelines for your sport and where you are on the recruiting calendar. Building a Website

How do I build my website?

Building your professional, personalized recruiting page is a simple process that anybody can do. Simply answer a few questions and upload some videos and files, and our platform automatically generates a comprehensive website for you in which you are the star!

Do I need to know how to do graphic design or write code to get a good result?

To create a good website, you do not need any graphic design or coding skills. Our system takes your materials and information and adds them to our pre-designed template, automatically generates the code and publishes your site to the internet.

What information do I need to build a website?

To build your website, you will to answer some simple questions, upload videos and photos demonstrating your abilities, information about your academic abilities, and support documents to substantiate the stats and info you are including on your site.

How long does it take to create the website?

Creating a website is a short and simple process. If you are well prepared and have access to the items you need you should be able to get through the process in about an hour.

What if I do not have all recommended items for my website available?

Since the website is about you, you should be able to pull together the information needed to complete the required sections of the site fairly easily. Some sections of the site are not required. So, if you do not have access to the optional items do not worry – you can leave them blank and the site simply will make the adjustment in the design for you. And you can always come back and add or edit your information at any time and as often as you wish.

How often can I update or edit my website?

You can update and edit your site as often as you like. It is recommended that you always keep your site up to date, so coaches aren’t given outdated information. High School athletes that put in the work tend to advance their skills rapidly. So if you have better data to share be sure to add it!

Can I change the fonts and colors on the website?

To ensure that your website looks professional and cohesive, we do not allow users to change things like colors or fonts. Our format has been created by professional designers, who know how to best organize and feature specific information that will catch the eye of a coach. Deviating from this would lessen your ability to get noticed.

Can I reorganize the information on the website?

We allow our users to organize info in each section any way they desire. However, we do not allow our athletes to change the order of the categories. We do this because we have found that coaches are interested in specific information, formatted a specific way. Our site presents your information in the best possible way.

What if I do not want to include some sections of the website?

You are not required to include every section on your website. In the website builder, the starred sections are required and the unstarred sections are not, meaning they are optional.

Why do you limit the number of videos, words, etc. on your website template?

We limit the number of videos and words on websites because we like to bring attention to your greatest highlights and achievements. If there is too much included on a site, coaches can be overwhelmed with information.

Support

What if I get stuck on something when creating the website?

As you are answering the questions needed to build your site you will notice that most questions have a circle with an “i” in it. Clicking on this circle will provide you some additional detail and guidance for completing that step of the process.

Will you build the site for me?

We do not offer to build sites for our customers. We make the website building process easy and simple so that anybody can do it.

I edited and published my changes, but they are not showing up on the internet – what can I do?

If you edit your changes and they don’t show up, make sure that you hit the save button after you enter them. Then at the end be sure to publish your site. In addition, sometimes web browsers store old pages of sites, so if you are making an update and have saved and published your site correctly and the old information is showing, you likely need to clear the cache in your browser. Then reload the page and your corrections should now be visible.

I have a website and I just got committed to a university, should I take down my site?

If you have a website and commit to a school, we recommend to still maintain your site. You can then use it to promote yourself for the next level after college. The only caveat is that you should be sure to update the commitment section of the site, so coaches from other colleges or universities do not think you are still available.

Communicating with Coaches, Scouts, Recruiters and Administrators

How do I send them my information?

After you log in, on your dashboard you can find a section about communicating. In this section you can send coaches your information, as well as view the history of the communications you sent. You can also copy your website link and send it via text or email to whomever you wish.

Are there any restrictions on when I can communicate?

There are restrictions on when you can communicate called quiet periods. They change every year and depend on each sport, division, and level. For additional information, check out these links:

Will Athlete Insite share my information with anyone?

Athlete Insite will never share your information with anyone without your expressed permission. Your site will be public on the internet, but for the most part the only time people will know about your site is when you give them the link.

How do I keep track of who I sent my website to?

You can keep track of who you sent your website to through our communication log. It keeps track of who you’ve communicated with, the date it happened, and the conversation.

Publishing Guidelines

Can I put whatever I want on the website?

You can put whatever you feel is important for coaches to know about you on your site provided it’s appropriate and meets our guidelines. If your site contains inappropriate content, you have the risk of getting your site taken down and having your account closed. For additional information see our Publishing Guidelines.

Can I take images from the Internet to put on my website?

You cannot take images from the internet and put them on your site. All of the content on your site must be owned by you, and the use of copyrighted content that you do not own is infringing on the owner’s rights. The owner of the content could pursue an action against you for unauthorized use of their intellectual property. So, if in doubt, it is best not to use something unless you own it or have the rights to use it. If we find out or receive a complaint about unauthorized use of other people’s intellectual property, your site is subject to being removed and your account may be closed.

I received a notice that there was a problem with something I put on my website – what happens now?

If a third party has contacted you about materials you placed on your website, you must log into your site and remove them right away. Athlete InSite does not check to see if account holders have the rights to use the material they post. That is 100% the responsibility of the account holder.

How do I know if the materials I want to use are copyrighted by someone else?

If you are using videos or photos created by a professional service, there is a good chance they control the rights and where you can use the items. Contact any photo or video provider to get their permission before you post the files to your site. If the photos and videos were taken by you or someone like your parents or friends, then you probably do not have to worry about it.

Payments

What does it cost to have an Athlete Insite website?

Athlete Insite websites are very affordable. Our monthly plan costs only $4.99 per month and you can save $9.98 by purchasing our annual plan of $49.99 per year.

How do I pay for a website?

When you register you will be asked to select a plan and make the payment for your site. Prices start at $4.99 and can be cancelled at any time. Once you choose a plan you will be sent through our shopping cart process. We accept Mastercard and Visa credit and debit cards. If you are under the age of 18, be sure to have your parent or guardian help you through the process.

I am under 18 – can I still purchase a website?

If you are under 18 years old, you are allowed to purchase a site with the permission of a parent or guardian.

Do I have to sign a contract?

Athlete Insite requires no contracts. No commitments. You can cancel for any reason at any time. No questions asked.

Can I upgrade from a monthly to annual plan?

You can upgrade from a monthly to annual plan by going to your dashboard, selecting my plan, checking the annual plan checkbox and clicking submit. Once your current billing cycle ends you will then be charged for the annual plan.

I want a website but cannot afford it – can you help?

At Athlete InSite we believe all athletes should get a fair chance at realizing their dreams. We never want money to be the reason why you can’t take advantage of our service. Contact us and maybe we can help.

I am an athlete with lots of social media followers – if I promote your service can I earn commissions?

If you have a large social media following, contact us and inquire about our ambassador program. You can earn a commission on the sales you bring to us through promoting Athlete InSite in your social media.

I sell a product or service that is targeted to student athletes – do you rent your list?

Athlete InSite does not rent our list – for additional information see our Privacy Policy.

Do you offer advertising on your website?

We do not currently offer advertising on our website, however if you have a product or service that is a fit for our users contact us as we like to partner with others in the industry to bring additional value to our users.

I work with lots of athletes – can I promote and sell your service to them?

If you work with or know athletes that may be interested, contact us about our affiliate program in which you can earn a commission on sales generated from your leads.

This privacy policy governs your use of software application that were created by Athlete InSite. The Athlete InSite tools help the user gather a comprehensive “snapshot” of the user’s accomplishments and abilities and share information with others within the approved guidelines of the user.

What information does the platform obtain and how is it used?

The website and online tools (collectively the “platform”) collect information from the user using a simple process of questions and uploading of content (images, videos, documents, etc.). This information is used to provide information about the athlete to educational institutions and their staff regarding attending their institution, playing sports in college, and potentially receiving scholarships. The tools also collect account information and sharing preferences of the licensed user. The platform does not share any information about the user(s) or the data collected without the express written consent of the user, with the exception of aggregated data, which does not include personal information, which is aggregated together anonymously and used for benchmarking purposes.

User Provided Information

The Platform obtains the information you provide when you download and use the tools.

When you register with us and use our website creation tools, you generally provide (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) information you enter into our system when using the platform, such as other personal or performance information.

We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

Automatically Collected Information

In addition, the platform may collect certain information automatically, including, but not limited to, the type of computer or mobile device you use, your computer or mobile devices unique ID, the IP address of your computer or mobile device, your operating system, the type of Internet browsers you use, and information about the way you use the platform.

Do the Applications collect precise real time location information of the device?

The platform may collect information about the location of your device but solely for the purposes of providing the user targeted content. We do not share this information with any third parties.

Do third parties see and/or have access to information obtained by the Applications?

Only aggregated, anonymous data is periodically transmitted to external services to help us improve the platform and our service. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information;

– as required by law, such as to comply with a subpoena, or similar legal process;

– when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

What are my opt-out rights?

You can stop all collection of information by the Platform easily by deleting any account you may have created and stopping use of the platform. You can also request to opt-out via email, at info@athleteinsite.com. You may also use the link on your account page or contact the Company directly to have your registration removed from our system.

Data Retention Policy, Managing Your Information

We will retain user provided data for as long as you use the platform and for a reasonable time thereafter. We will retain your information for up to 24 months and thereafter may store it only in aggregate. We may, at our sole discretion, store your data longer than 24 months. The only exception is if you elect to delete or cancel your registration. In this case your data will be fully removed from our system and is permanent. Accounts that are deleted are not recoverable.

Children

While our app and its content are suitable for all ages because our platform provides guidance for training purposes, minors under the age of 18 requires the permission of a parent or guardian during the registration process to use our Platform. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at info@athleteinsite.com. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Platform. We also use an industry leading provider for all transactions and payment processing. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches. We are not responsible for breaches caused by third party providers, general security issues that may arise from using mobile or web-based services, or carelessness by users. We will never ask a user for their social security number when servicing your account. If someone posing as a representative of our business contacts you and asks for this information please alert us immediately at info@athleteinsite.com.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy on our website at www.replay.app and/or www.perfectgame.org and/or informing you via email or text message. Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the “Right to Know”). Once we receive your request and confirm your identity (see exercising your rights to know or delete), we will disclose to you:

Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “Right to Delete”). 5.     Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. Seq.).

6.     Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.

7.     Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

8.     Comply with a legal obligation.

9.     Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct -our service providers to take similar action.

Exercising Your Rights to Know or Delete

To exercise your rights- to know or delete described above, please submit a request by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.

You may also make a request to know or delete on behalf of your child by calling or emailing us at the phone number or email address listed above.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

–        Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include, but is not limited to, a driver’s license, passport, or other photo identification.

–        Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You do not need to create an account with us to submit a request to know or delete. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact info@athleteinsite.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not, because of you exercising any rights under the CCPA:
